{"id":31891,"date":"2023-12-20T11:19:44","date_gmt":"2023-12-20T10:19:44","guid":{"rendered":"https:\/\/www.i3s.es\/blog\/get-to-know-the-requirements-of-the-crea-y-crece-law-on-electronic-invoicing\/"},"modified":"2024-01-09T12:26:24","modified_gmt":"2024-01-09T11:26:24","slug":"get-to-know-the-requirements-of-the-crea-y-crece-law-on-electronic-invoicing","status":"publish","type":"post","link":"https:\/\/www.i3s.es\/en\/blog\/get-to-know-the-requirements-of-the-crea-y-crece-law-on-electronic-invoicing\/","title":{"rendered":"Get to know the requirements of the &#8220;Crea y Crece&#8221; Law on electronic invoicing"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"31891\" class=\"elementor elementor-31891 elementor-31865\" data-elementor-post-type=\"post\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-8c8ceb7 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"8c8ceb7\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-5a1b813\" data-id=\"5a1b813\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-c7568bf elementor-widget elementor-widget-text-editor\" data-id=\"c7568bf\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">In September 2022, the Congress of Deputies approved the<\/span> <a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2022-15818\" rel=\"nofollow noopener\" target=\"_blank\"><b><i>Law for the Creation and Growth of Companies<\/i><\/b><b>,<\/b> <\/a><span style=\"font-weight: 400;\">better known as <\/span><b>Crea y Crece&#8221; law;<\/b><span style=\"font-weight: 400;\"> conceived with four objectives: <\/span> <\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Facilitate the creation of new companies.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Reduce regulatory hurdles.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fight against delinquency.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Promote the growth and expansion of organizations.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Four objectives that include a fundamental aspect for the entire business fabric: complete digitalization. <\/span><b>complete digitalization <\/b><span style=\"font-weight: 400;\">of its processes and services.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This legislative measure is, in fact, within the framework of the <\/span><a href=\"https:\/\/planderecuperacion.gob.es\/\" rel=\"nofollow noopener\" target=\"_blank\"><br \/>\n  <b>Recovery, Transformation and Resilience Plan, called to<\/b><br \/>\n<\/a><span style=\"font-weight: 400;\">Plan, aimed at <\/span><b>increase the competitiveness of organizations through innovation and <\/b><span style=\"font-weight: 400;\">through innovation and sustainability.<\/span><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-88ef12a elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"88ef12a\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-9f13a3f\" data-id=\"9f13a3f\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-4686fc7 elementor-widget elementor-widget-heading\" data-id=\"4686fc7\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">E-invoicing: digital consolidation and the fight against late payments<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-30fde21 elementor-widget elementor-widget-text-editor\" data-id=\"30fde21\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<\/p>\n<p><span style=\"font-weight: 400;\">But what does electronic invoicing have to do with this? Well, the  <\/span><b>Crea y Crece&#8221; law  <\/b><span style=\"font-weight: 400;\">establishes mandatory requirements that will be gradually adopted over time by organizations. And among these requirements is that of the  <\/span><b>electronic invoicing<\/b><span style=\"font-weight: 400;\"> as <\/span><b>a further step towards the consolidation of the digitalization process. <\/b> <\/p>\n<p><span style=\"font-weight: 400;\">But not only exclusively. The  <\/span><b>electronic invoicing<\/b><span style=\"font-weight: 400;\"> responds to another of the objectives of the aforementioned law: <\/span><b>to fight against late payment<\/b><span style=\"font-weight: 400;\">especially among SMEs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Thus, it will be mandatory to issue and send electronic invoices in all commercial relations with companies and freelancers. The first stage cannot start until 12 months after it is untested, which could be later this year. That no company or self-employed person should wait any longer for the acquisition of a  <\/span><a href=\"https:\/\/www.i3s.es\/en\/services\/electronic-invoicing\/\"><br \/>\n  <b>electronic invoicing software<\/b><br \/>\n<\/a><span style=\"font-weight: 400;\"> able to meet the new requirements of the<\/span><b> the &#8220;Crea y Crece&#8221; law <\/b><span style=\"font-weight: 400;\">and ensure interoperability between the different platforms.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In fact, the<\/span><a href=\"https:\/\/sede.agenciatributaria.gob.es\/\" rel=\"nofollow noopener\" target=\"_blank\"><br \/>\n  <b> Tax Agency<\/b><br \/>\n<\/a><span style=\"font-weight: 400;\"> will use the information from the electronic invoices sent (and with a direct copy to the public electronic invoicing system) to ensure compliance with the regulation through an analysis process. <\/span> <\/p>\n<p><span style=\"font-weight: 400;\">Moreover, the tax information will be provided to the new <\/span><b>State Observatory of Private Delinquency<\/b><span style=\"font-weight: 400;\"> so that it can draw up its annual list of defaulting companies, i.e., those that have failed to meet the payment deadlines set out in the new legislation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The new<\/span><b> electronic invoicing software <\/b> <span style=\"font-weight: 400;\">must have a certificate of suitability that meets the characteristics established by the Administrations in this regard. For example, allowing the rectification of an invoice, but not deleting or altering its computer record, or allowing the voluntary remission of the invoice to the records of the Tax Agency automatically.  <\/span><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-190534c elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"190534c\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column
