Its main objective is to minimize the environmental impact of packaging and promote the <strong>circular economy<\/strong>. <\/p><p>However, one of the most relevant obligations that this decree sets for companies is the submission of an annual report to the <strong>Ministry of Ecological Transition and Demographic Challenge (MITECO).<\/strong><\/p><p>We analyze RD 1055\/22 on packaging and packaging waste, the obligations it establishes and the problems faced by companies that are making this <strong>mandatory annual report to MITECO<\/strong> almost manually.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9d769cf elementor-widget elementor-widget-heading\" data-id=\"9d769cf\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Context of RD 1055\/22 on packaging and packaging waste<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dfe3e5f elementor-widget elementor-widget-text-editor\" data-id=\"dfe3e5f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p> <\/p><p>RD 1055\/22 was enacted in a context of growing concern for <strong>sustainability and waste management<\/strong>. The Royal Decree seeks to ensure that companies take responsibility for the<strong> packaging<\/strong> they place on the market and the waste they generate.  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0238a8b elementor-widget elementor-widget-heading\" data-id=\"0238a8b\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Objectives of RD 1055\/22<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8174e11 elementor-widget elementor-widget-text-editor\" data-id=\"8174e11\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p> <\/p><p>The main objectives of RD 1055\/22 are:<\/p><ol><li><strong>Minimize waste generation<\/strong>. Details of the different types of containers that the company has marketed. <\/li><li><strong>Waste management<\/strong>. Information on how the waste generated has been managed, including data on recycling and reuse. <\/li><li><strong>Compliance with objectives<\/strong>. Evaluation of whether the reduction and recycling objectives established by the decree have been achieved. <\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ec195bb elementor-widget elementor-widget-heading\" data-id=\"ec195bb\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What problems does MITECO reporting create for companies?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cffeb0c elementor-widget elementor-widget-text-editor\" data-id=\"cffeb0c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p> <\/p><p>Despite the relevance of this report, many companies face serious challenges in complying with this obligation almost manually. Some of the most prominent problems include: <\/p><ol><li><strong>Administrative burden<\/strong><\/li><\/ol><p>The preparation of the annual report involves a significant administrative burden. Companies must collect <strong>data<\/strong> from different departments, a process that is often time-consuming and tedious. This burden affects productivity and forces resources to be diverted from other critical areas of the business.  <\/p><ol start=\"2\"><li><strong>Lack of data standardization<\/strong><\/li><\/ol><p>Packaging and waste data collection often lacks <strong>standardization<\/strong>. Different departments may use different methods to measure and report information, leading to inconsistencies in the data. This lack of uniformity makes accurate and complete reporting difficult.  <\/p><ol start=\"3\"><li><strong>Difficulties in data management<\/strong><\/li><\/ol><p>Many companies do not have adequate systems in place to manage the information required for reporting. This means that they often have to resort to<strong> manual methods<\/strong>, such as spreadsheets, which increases the risk of errors and omissions. The lack of appropriate technology makes the data collection process even more complicated.  <\/p><ol start=\"4\"><li><strong>Lack of knowledge and training<\/strong><\/li><\/ol><p>Not all companies have the trained personnel to understand and comply with the requirements of RD 1055\/22. Lack of knowledge about the regulations and specific requirements leads to errors in reporting and, consequently, to sanctions by MITECO. <\/p><ol start=\"5\"><li><strong>Penalties and legal consequences<\/strong><\/li><\/ol><p>Failure to comply with the obligations established by RD 1055\/22 results in economic and legal sanctions. This facilitates the reporting process and reduces the possibility of errors. <\/p><p> <\/p><p>RD 1055\/22 on packaging and packaging waste represents an important step towards sustainability and the circular economy in Spain. However, the annual reporting obligations imposed on companies present significant challenges, especially when carried out manually. <\/p><p>To address these problems, it is a priority for companies to adopt technological solutions, train their personnel and establish standardized protocols.
