The <\/span>Royal Decree 1055\/2022<\/span><\/a>known as <\/span>Packaging Law \/ RD \/ 1055\/22<\/b>has made possible <\/span>a new legal framework<\/b> for the management of packaging and packaging waste.<\/b> in Spain. The objective: to take on board the EU strategy for the reduction and more appropriate management of waste, especially plastics, which is embodied in the <\/span>Directive (EU) 2018\/852<\/span><\/a>. <\/p>

The decree, which came into force on December 27, 2022, establishes a series of concrete measures that embark on several paths: <\/span><\/p>

The <\/span>preventing the generation of waste<\/b>This approach must permeate the entire packaging value chain, from conception to disposal, in order to be successful.<\/span><\/p>

That of <\/span>to promote their reuse<\/b>to promote a circular economy and reduce dependence on virgin raw materials and the generation of huge quantities of waste.<\/span><\/p>

The <\/span>increase recycling<\/b>The new recycling program: ambitious targets are set to enable the reuse of different materials for different uses and to avoid contamination due to malpractice. New information on how to recycle correctly is also included. <\/span><\/p>

The <\/span>promoting eco-design<\/b>The new packaging: it becomes the most powerful tool for waste prevention and reuse. It seeks to reduce the size, weight and materials used in packaging and to facilitate a design that is committed to durability and repairability. <\/span><\/p>

The <\/span>Packaging Law \/ RD \/ 1055\/22<\/b> also establishes three categories of packaging: household packaging, commercial packaging and industrial packaging and specific types of packaging, such as service packaging, reusable packaging, etc., subject to various measures.<\/span><\/p>

On January 22, 2025, Regulation (EU 2025\/40 of the European Parliament and Council of 19 December 2024 of <\/span>Regulation (EU) 2025\/40 of the European Parliament and of the Council of December 19, 2024.<\/span><\/a>The new directive, on packaging and packaging waste, establishes harmonized standards for the management of packaging and packaging waste for all EU member states. <\/p>

This decree has a significant impact on various sectors where packaging is very present, especially the food industry, distribution channels, packaging producers and waste management systems. <\/span><\/p>

In all of them, companies must adapt to new obligations, such as the annual declaration of packaging, the implementation of prevention and eco-design business plans, and the management of waste in accordance with established objectives. <\/span><\/p>

These are some of the most important measures:<\/span><\/p>

Extended Producer Responsibility (EPR)<\/b> <\/span><\/p>

Polluter pays<\/span><\/i>. This is the principle adopted by the EU with regard to its environmental strategy. A principle that passes on to packaging manufacturers the cost of collecting and treating the waste they generate through the products they market. <\/span><\/p>

The objective is none other than to force them to improve the processes of prevention, reuse and recycling. How? For example, by designing products with less environmental impact, developing systems for better identification of packaging or their total involvement in the waste management system by accepting the return of their reusable products. <\/span><\/p>

The RAP seeks to ensure that the producing companies contribute to the waste management system and that they do so by paying a fee. The fee is paid to an authorized waste management company for the collection and treatment of waste. Each company pays according to the amount of waste it generates, which involves the preparation of a declaration, in this case of packaging. <\/span><\/p>

The <\/span>Waste and Contaminated Soil Law 7\/2022 <\/span><\/a> introduced novelties with respect to the <\/span>Extended Producer Responsibility<\/b> in Spain, such as its scope to commercial and industrial packaging and the extension of costs, among others. The <\/span>Royal Decree 1055\/2022 on Packaging and Packaging Waste<\/b> brought with it even more, such as the <\/span>ecomodulation<\/span><\/a> for calculating the contribution of companies to the waste management system, in order to make it more equitable. <\/span> <\/p>

In short, ecomodulation seeks to adjust producers’ financial contributions according to the environmental impact of their packaging, thus encouraging eco-design and the use of more recyclable materials.<\/span><\/p>

Register of Product Producers<\/b> <\/span><\/p>

The Waste and Contaminated Soils Law 7\/2022 introduced, among its novelties in matters of <\/span>Extended Producer Responsibility, the creation of an<\/span> The aim is to maximize control and traceability over the system for the correct management of packaging waste. The <\/span>packaging section of the Register of Product Producers, a<\/span><\/a>a <\/span>The packaging section of the Product Producers Register, a space provided by the Ministry for Ecological Transition and the Demographic Challenge (MITERD), <\/span>serves not only to register but also to report annually important and mandatory information on the placing on the market of household, commercial and\/or industrial packaging.<\/span><\/p>

Deposit, Return and Return System (DRDS)<\/b><\/p>

The Deposit, Return and Refund System (DRS) is a mechanism for the management of packaging waste that consists of charging an additional deposit when purchasing a packaged product, which is refunded to the consumer when the empty container is returned to a specific collection point. This system, which has been used for years in other EU countries, encourages recycling and reuse of packaging by giving customers a financial incentive to return it. <\/span><\/p>

In Spain, the implementation of DRS systems is contemplated for certain types of packaging, specifically, <\/span>plastic beverage bottles as of November 2026, in order to ensure their correct management.<\/span><\/a>in order to guarantee their correct management. <\/span> <\/p>

Prevention and eco-design:<\/b> <\/span><\/p>

The commitment to eco-design in the EU is strong. In fact, there are <\/span>ecodesign requirements<\/span><\/a> for certain product groups, such as electronic devices. The objective is for all products to be <\/span>durable, repairable and sustainable<\/span><\/a>.<\/span><\/p>

In the case of packaging, for example, the aforementioned law establishes a weight reduction through an eco-design approach in packaging of 13 % in 2025 and 15 % in 2030 compared to those generated in 2010. <\/span>As well as the r<\/span>reduction in the number of single-use plastic beverage bottles on the market by 20 % by 2030 compared to 2022. By 2030, all packaging should be recyclable and, if possible, reusable. <\/span><\/p>

<\/span>Bulk sales:<\/b><\/p>

Stores must adopt the necessary measures to ensure the bulk sale of certain foods such as fruits, vegetables, legumes, dried fruits and nuts…. In the case of surfaces equal to or larger than 400 square meters, they must allocate at least 20% of their sales area to the offer of products in bulk or in reusable packaging. <\/span> <\/span><\/p>

The <\/span>Packaging Law\/ RD \/ 1055\/22<\/b> also set new horizons in the percentage of <\/span>the percentage of recycled plastic<\/b> that packaging should contain by 2025 and 2030. Generally speaking (as specifications exist) plastic packaging not made of compostable plastic must contain, by 2025, <\/span>25 % rPET in PET containers and 20 % rPlastic in all other non-PET containers<\/b>. By 2030, these percentages increase to 30 % rPlastic in all plastic packaging. The amount of recycled plastic used must be certified by an accredited body. <\/span><\/p>

Complying with all these measures can be difficult for smaller organizations.
