New Law on packaging and packaging waste. Main keys

The Royal Decree 1055/2022known as Packaging Law / RD / 1055/22has made possible a new legal framework for the management of packaging and packaging waste. in Spain. The objective: to take on board the EU strategy for the reduction and more appropriate management of waste, especially plastics, which is embodied in the Directive (EU) 2018/852. The Packaging Law / RD / 1055/22 also establishes three categories of packaging: household packaging, commercial packaging and industrial packaging and specific types of packaging, such as service packaging, reusable packaging, etc., subject to various measures.

This decree has a significant impact on various sectors where packaging is very present, especially the food industry, distribution channels, packaging producers and waste management systems.

In all of them, companies must adapt to new obligations, such as the annual declaration of packaging, the implementation of prevention and eco-design business plans, and the management of waste in accordance with established objectives.

These are some of the most important measures:

Extended Producer Responsibility (EPR)

Polluter pays. This is the principle adopted by the EU with regard to its environmental strategy. A principle that passes on to packaging manufacturers the cost of collecting and treating the waste they generate through the products they market.

The objective is none other than to force them to improve the processes of prevention, reuse and recycling. How? For example, by designing products with less environmental impact, developing systems for better identification of packaging or their total involvement in the waste management system by accepting the return of their reusable products.

The RAP seeks to ensure that the producing companies contribute to the waste management system and that they do so by paying a fee. The fee is paid to an authorized waste management company for the collection and treatment of waste. Each company pays according to the amount of waste it generates, which involves the preparation of a declaration, in this case of packaging.

The Waste and Contaminated Soil Law 7/2022 introduced novelties with respect to the Extended Producer Responsibility in Spain, such as its scope to commercial and industrial packaging and the extension of costs, among others. The Royal Decree 1055/2022 on Packaging and Packaging Waste brought with it even more, such as the ecomodulation for calculating the contribution of companies to the waste management system, in order to make it more equitable.

In short, ecomodulation seeks to adjust producers’ financial contributions according to the environmental impact of their packaging, thus encouraging eco-design and the use of more recyclable materials.

This system, which has been used for years in other EU countries, encourages recycling and reuse of packaging by giving customers a financial incentive to return it.

In Spain, the implementation of DRS systems is contemplated for certain types of packaging, specifically, plastic beverage bottles as of November 2026, in order to ensure their correct management.in order to guarantee their correct management.

Prevention and eco-design:

Bulk sales:

Stores must adopt the necessary measures to ensure the bulk sale of certain foods such as fruits, vegetables, legumes, dried fruits and nuts…. In the case of surfaces equal to or larger than 400 square meters, they must allocate at least 20% of their sales area to the offer of products in bulk or in reusable packaging.

The Packaging Law/ RD / 1055/22 also set new horizons in the percentage of the percentage of recycled plastic that packaging should contain by 2025 and 2030. Generally speaking (as specifications exist) plastic packaging not made of compostable plastic must contain, by 2025, 25 % rPET in PET containers and 20 % rPlastic in all other non-PET containers. By 2030, these percentages increase to 30 % rPlastic in all plastic packaging. The amount of recycled plastic used must be certified by an accredited body.
