Any product made of materials of any nature and used to contain,
protect, handle, distribute and present goods, from raw materials to finished articles
, at any stage of the manufacturing, distribution and consumption chain.
All disposable articles used for the same purpose shall also be considered packaging.

What sanctions are contemplated by the new regulations for companies that do not comply with their obligations?

Companies that fail to comply with the obligations contemplated in the new regulations face various penalties, depending on the nature and seriousness of the non-compliance.

Financial penalties

These can be up to €3,000 in the case of minor infringements and up to €60,000 in the case of serious infringements.

Suspension of activities

In cases of serious non-compliance, the company’ s activity may be temporarily suspended.

Rectification obligation

Companies may be required to correct their practices and comply with the regulations within a period of time.

Liability

Companies may be liable for waste management costs if they fail to comply with their obligations.

Publication of violations

In some cases, breaches may be published, affecting the company’s reputation.

How does the Product Producer Registration?

It is a system established by Royal Decree 1055/2022 that aims to identify and control all producers who place packaging on the market. This registry is essential to ensure compliance with Extended Producer Responsibility (EPR) obligations and to facilitate waste management.
